Terms and Conditions for delicious Subs Club August 2010
1. Information on how to enter the draws and win prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over who during the promotional period as stipulated on the promotional panel are a current and valid subscriber to delicious Magazine. Employees of News Magazines Pty Limited, Salmat Interactive PTY LTD, their advertising agencies, newsagents, subagents, respective employees and their immediate families are ineligible to enter.
3. This competition commences 22nd July 2010 00:01 and ends 17th August 2010 23:59 (promotional period). All times are AEDST or AEST which ever is applicable in NSW at the time.
4. Incomplete, indecipherable or illegible entries will be deemed invalid.
5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to using automated means to enter). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. Winners will be drawn at 12.00pm AEST on Thursday 19th August 2010 at Salmat Interactive, Innovation Place, Level 17, 100 Arthur Street North Sydney, NSW 2060.
7. Winners will be notified within 2 days of the draw. Winners will be notified by email or phone, and the winners will be published the on the magazine website, www.deliciousmagazine.com.au. Winners will also be published in the public notices section of The Australian on 25th August 2010.
8. The Promoter’s decision is final and no correspondence will be entered into.
9. There are two prizes to be won each consisting of Ilve 28L stainless steel microwave at $699 each.
10. Total prize pool is valued up to $1,398.00
11. If a prize is unclaimed an unclaimed prize draw will take place on Monday 29th November 2010 at 12:00 at the same place as the original draw. The winner will be notified by phone and in writing within 7 days of the draw.
12. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
13. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
14. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
15. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of any prize.
16. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend the competition - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the competition (the Lotteries Departments).
17. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
